Medical Test Sites (MTS) Rules in Progress

Rules in Progress

The rules writing process is open to the public. The public is welcome to take part in helping us write rules. Rules are also known as regulations, Washington Administrative Code, or WAC. The rule-making process includes public notices and workshops, and usually a public hearing before a rule becomes final.

Current Rules in Progress

The Washington Department of Health (department) Medical Test Site (MTS) program is conducting exception rulemaking to amend Chapter 246-338 WAC to align with federal requirements. The rule change will affect naturopaths licensed under chapter 18.36A and midwives licensed under chapter 18.50 RCW by removing their ability to serve as a laboratory director or testing personnel of a facility holding a provider performed microscopic procedure (PPMP) MTS license. A detailed description of the rulemaking (PDF) is available.

A CR-102 was filed with the Code Reviser as WSR 24-05-019 (PDF) on February 9, 2024. Interested parties are invited to attend the upcoming public rules hearing on April 4, 2024 at 2:00 pm, which will be offered in a hybrid format. Participants can attend public rules hearing at the physical location noted in the CR-102 or register in advance for the webinar. Written comments may be submitted online or sent to Jessica Holloway, PO Box 47843, Olympia, WA 98504-7843 by April 4, 2024, at 5:00 pm.
