The rules writing process is open to the public. The public is welcome to take part in helping us write rules. Rules are also known as regulations, Washington Administrative Code, or WAC. The rule-making process includes public notices and workshops, and usually a public hearing before a rule becomes final.

Current rules in progress
Expansion of those that may be exempt - Senate Bill 5811 expands the exemption to include those related by marriage or domestic partnership. The department is amending WAC 246-980-025 and WAC 246-980-110 to reflect the expansion of those that may be exempt from holding a home care aide certification.
Extend alternative timelines for certification - ESHB 1120 established alternative time frames for certification during the COVID-19 public health emergency. As of April 25, 2025, the emergency rule extending alternative timelines has been extended through July 31, 2025.
Delaying the home care aide certification requirements - On May 17, 2025, HB5672 was signed into law, allowing the Department of Health, in collaboration with the State Auditor’s Office, to extend the certification timeline for long-term care workers while the state audit is being conducted.
Standardizes basic training and certification requirements - On April 7, 2025, HB1142 was signed into law, standardizing basic training and clarifying the role of long-term care workers providing in-home care for their family members, including spouses or domestic partners, which amends RCW 18-88B.041 and 74.39A.076.
