X-Rays in the Healing Arts Rulemaking

What's Happening?

We are considering amending rules in chapter 246-225 WAC to address radiation therapy, fluoroscopic X-ray, and shielding plan requirements.

Radiation Therapy

Radiation therapy is a high dose modality of radiation used in lifesaving efforts for those diagnosed with cancer. The current rules cannot effectively regulate the use of radiation therapy because of advancements in technology. Rulemaking is necessary to ensure that patients are receiving the correct prescribed dose at the correct location.

Radiation therapy rules are currently found in two sections: WAC 246-225-120 and WAC 246-225-130. We are considering amending these sections to establish standards for machine performance and quality control under a new chapter. This rulemaking will not limit the amount of radiation that may be delivered. Only amendments to machine generated ionizing radiation will be considered, and not radiopharmaceuticals or radioactive materials.

Fluoroscopic X-ray

Fluoroscopic X-ray rules (WAC 246-225-050) have not been updated in nearly 30 years. With innovation and development in computers, software processing, X-ray detectors, fluoroscopic modalities, and X-ray tube capabilities, advancements in fluoroscopic X-ray machines have far outpaced the rules in effect today. Fluoroscopic X-ray machines are capable of substantial and prolonged output of ionizing radiation and account for some of the highest radiation doses delivered both directly to patients and indirectly to X-ray machine operators and other staff during procedures. We are considering amending WAC 246-225-050 to address advances in technology and to address occupational and public radiation exposure under a new chapter.

Plan Review

The shielding requirements in WAC 246-225-030, General requirements – Plan review, are outdated. Rulemaking is needed to reflect technological advancements and current practices to ensure public health and safety. We are considering amending WAC 246-225-030 to retain design requirements and adopting a new section to address shielding requirements.

Draft rules were developed, considering advances in technology, federal guidelines, and other states regulations, with the input of a rules advisory committee comprised of subject matter experts in radiation therapy and fluoroscopic X-ray.
