CR-101 Rule Inquiry Stage – Drafting of Proposed Rules
The first phase of rulemaking is the inquiry stage. The inquiry phase is intended to allow all interested parties to participate in the rule development process from the beginning.
Offering Proposals on Draft Rules during the Rule Inquiry Stage
The Department of Health will publish revised draft rules language. Any interested party may submit a written proposal to modify the draft rules language by using the fillable 346-067 Rule Proposal Form (Word). All written proposals will be assembled into a report titled “Report on Proposals”. notifications will be sent via email to our subscribers. If you're interested in updates, subscribe here.
A public workshop (Workshop 1) will review the “Report on Proposals.” The report will serve as an agenda for the meeting. Each proposal will be reviewed and discussed in a public forum, and each attendee may speak on any proposal. Workshop attendees will make an advisory opinion on each proposal, either to support or not to support. We want all interested parties to have the opportunity to review and comment on proposed changes, so please limit new ideas to this stage.
Offering Comments on Draft Rules during the Rule Inquiry Stage
After Workshop 1, the department will publish the list of advisory opinions on each proposal submitted. Any interested party may submit a comment on one of the previously submitted proposals. These comments may support, oppose or modify a previous proposal. These written comments will be assembled into a report titled “Report on Comments”. This report will be published on this website and notifications will be sent via email to our subscribers. If you are interested in updates, subscribe here.

Each proposal will be reviewed and discussed in a public forum, and each attendee may speak on any proposal. An advisory opinion will be produced for each proposal.
Note: Interested parties' input is highly valued and will be carefully considered during the decision-making process. These advisory opinions are advisory only. The department is solely responsible for the drafting and final language of the rule.
CR-102 Rule Proposal Stage – Preparing the Proposed Rules
After Workshop 2, the department will carefully review and consider all advisory opinions gathered during the rule drafting and comment phase. From this, the department will create proposed rules that will be filed in a CR-102 rules package with the Office of the Code Reviser. This filing will be will be published on this website and notifications will be sent via email to our subscribers.
Public Hearing for Proposed Rules
A third public meeting (CR-102 public hearing) will be held. This meeting may provide an opportunity for all interested parties to make oral or written comments on the proposed rules.
CR-103 - Adoption Phase of Rules
Depending on the outcome of that public hearing, the department will file a final revised rule with the Office of the Code Reviser as part of the rule adoption phase (CR-103). When the rule becomes effective 31 days from its filing date, the department will notify all stakeholders and interested parties of the official effective date of the revised rules.
