Nuclear Regulatory Commission – Federally Required Rule Revision

What's Happening?

We held a public hearing on August 30, 2023 and adopted amendments to four chapters of rules to adopt federal requirements without making material changes to the rule. The rule amendments are identified by NRC Regulation Amendments Tracking System (RATS) and Federal Register (FR) numbers as follows: 

  • 2020-2 (PDF) Social Security Fraud Prevention – 85 FR 33527 (PDF) and 85 FR 44685 (PDF): Amends chapter 246-240 WAC to make miscellaneous corrections that are non-substantive changes to clarify rule language.  
  • 2020-3 (PDF) Miscellaneous Corrections – 85 FR 65656 (PDF): Amends chapters 246-221, -231, and -240 WAC to make non-substantive changes such as updating titles, removing outdated requirements, and updating outdated calculations.   
  • 2021-1 (PDF) Miscellaneous Corrections – 86 FR 43397 (PDF) and 86 FR 47209 (PDF): Amends chapters 246-221, -232, -237 and -240 WAC to remove outdated requirements, update organization names, and update license titles.  
  • 2021-2 (PDF) Miscellaneous Corrections – 86 FR 67839 (PDF): Amends chapter 246-237 WAC to correct a calculation.   
  • The department adopted other editorial and non-substantive changes.
  • The CR-103 – Rule-Making Order was filed on October 11, 2023. The rule will become effective November 11, 2023.

Why?

Under the formal agreement between the State of Washington and the U.S. Nuclear Regulatory Commission (NRC), we are required to remain compatible with NRC rules. This is done through rule amendments to make our state rules consistent with, and at least as stringent as, the NRC’s rules.
